Terms and Conditions
TERMS & CONDITIONS FOR CONSUMER
- All products will be shipped on receipt of monies.
- All goods will be properly packaged before shipping. Potter’s Kiln (UK) (‘the Company’) cannot accept responsibility of items lost or damaged during distribution.
- All handcrafted items are protected by copyright. Items may not be reproduced, modified or copied.
- All orders are processed manually to give personal service.
- Handcrafted items are sold on a ‘supply on demand’ bases. The delivery may take up to 28 days. The more intricate products could take longer but the customer will be informed. If this is unsatisfactory, monies can be refunded with the purchase of no products.
- All descriptions and sizing of Potter’s Kiln (UK) items are as accurate as possible. No claims can be issued for unforeseen errors within the depiction.
- Many of the collectables have historic value and were therefore bought to use or cherish. Signs of aging may be found, but this will only enhance the product to take your mind’s eye back into the years they were manufactured.
- Potter’s Kiln (UK) can only supply goods on availability. If item continues to be sold online but is not obtainable, you will be contacted to provide other options or a refund of payment.
- Any damaged goods must be returned to Potter’s Kiln (UK).
- LIMITATION OF LIABILITY
10.1 The following provisions set out the entire financial liability of the Company (including any liability for the acts or omissions of its employees, agents and sub-contractors) to the buyer in respect of:
- Any breach of these conditions;
- Any use made or resale by the buyer of any of the goods, or of any product incorporating any of the goods; and
- Any representation, statement or tortuous act or omission including negligence arising under or in connection with the contract.
10.3Nothing in these conditions excludes or limits the liability of the Company:
- For death or personal injury caused by the Company’s negligence: or
- Under section 2(3), Consumer Protection Act 1987: or
- For any matter which it would be illegal for the Company to exclude or attempt to exclude its liability: or
- For fraud or fraudulent misrepresentation
Subject to condition 10.2 and condition 10.3 the Company’s liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price.
10.5 Governing Law and Jurisdiction
- The contract, and nay dispute or claim arising out of it or its subject matter, shall be governed by, and construed in accordance with, the law of England and Wales.
- The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of, or in connection with, the contract or its subject matter.
REFUND, REPLACEMENT AND CANCELLATION TERMS
- Potter’s Kiln (UK) can only supply goods on availability. If item continues to be sold on line, but is not obtainable, you will be contacted to provide other options or a refund of payment.
- Aged items in the collectables section may have some light ware, which is to be expected. Potter’s Kiln (UK) tries to be accurate in the description, such as scratches, chips, cracks, hairlines and crazing. Hand-made glass, which have manufacturing blemishes, are considered as part of the uniqueness and are not considered as a problem.
- Potter’s Kiln (UK) makes every effort to be accurate in description and the photographic images, however, colours may vary slightly due to outside influences such as a variety of monitors etc. If wrongly described by Potter’s Kiln (UK) (except reasons given above) a full refund plus postage and packaging on return of the item will be given.
- If the customer decides that the item is not to their liking, a full refund will be given (not the postage) providing you contact Potter’s Kiln (UK) over the phone or email within 7 days of receipt and the item is returned in the condition it was received.
- A full refund will be immediately given on loss or damage, which is occurred during transit. In case of breakages, keep the item and original packaging for inspection as we will claim for compensation through the carrier.
